Abuse charge added on marijuana case

NM - A Portales woman faces child-abuse charges after her child tested positive for a chemical found in marijuana, according to police reports.
Catherine Houston-Sprayberry, 23, of Portales, faces charges of abandonment or abuse of a child, possession of paraphenalia and possession of marijuana.
The abuse charge is resulting from the 2-month-old child’s positive test for THC (delta-9-tetrahydrocannabinol), the main active ingredient in marijuana.
According to a police report, officers with the Portales Police Department reported to Houston-Sprayberry’s home on Sunday after being contacted by a member of her boyfriend’s family. The family member, who had taken the baby back to her home, gave the responding officer a marijuana pipe and said she found it on Houston-Sprayberry’s stomach, according to the report.
Houston-Sprayberry woke up after several attempts by officers. The baby was taken into the custody of Children Youth and Families Department and taken to Roosevelt General Hospital for an evaluation.
The police report states that three days later, a urine test indicated the presence of THC in the baby.
“The baby was around intensive marijuana smoke,” Portales Police Capt. Lonnie Berry said. “You have to be around quite a bit of it (to test positive through second-hand smoke).”
Houston-Sprayberry was arrested on Thursday. She was booked at the Roosevelt County Detention Center, but has been released on a $1,000 appearance bond.
Attempts to contact Houston-Sprayberry on Thursday were unsuccessful.
